GENERAL TERMS AND CONDITIONS FOR SALE OF TOUR PACKAGES

Terms and conditions, Tours27 informs the Traveler Consumer to read and carefully examine, before booking and purchasing, the following GENERAL CONDITIONS and expressly warns that Tours27 promotes the use of this site for the booking and purchase of what is described therein to all those users who have expressly accepted, without exception or reservation, the following GENERAL CONDITIONS.

Objests

1 Object: Tours27 exclusively carries out the intermediation activity for all the tourist services offered through this site. These GENERAL CONDITIONS do not replace but are in addition to the terms and conditions of the single Tourist Organizer who is the actual subject who carries out the combination of the elements referred to in art 3 of these GENERAL CONDITIONS. Therefore, the Traveler Consumer must refer, in addition to these GENERAL CONDITIONS, also to the specific conditions and terms relating to the booking and purchase of the chosen holiday package, present in the information sheets of the individual packages offered.

By booking and purchase we mean any holiday package order placed by the Consumer through this site and accepted by Tours27 and by the Tourist Organizer (the supplier who actually made the package). The supply of the purchased holiday package is subject to availability and presupposes the acceptance by the traveling consumer of the role of Tours27 as a mere intermediary of the chosen service. By making the reservation and purchase by the Consumer, the Consumer accepts these GENERAL CONDITIONS without reservations or exceptions.

2 Legislative Sources: The purchase and sale of a tourist package, whether it concerns services to be provided in national or foreign territory, is regulated – up to its repeal pursuant to art. 3 of Legislative Decree no. 79 of 23 May 2011 (the Tourism Code) – by Law 27/12/1977 nr. 1084 of ratification and execution of the International Convention relating to the travel contract (CC V) signed in Brussels on 23.4.1970 as applicable as well as by the Tourism Code (art.32-51) and subsequent amendments. Notion of tourist packages

3 Notion of Tourist Package: Pursuant to art. 34 of the Tourism Code the tourist packages concern trips, holidays, “all inclusive” circuits, tourist cruises, resulting from the combination by anyone and in any way made of at least two of the elements indicated below, sold or offered for sale at a price flat rate, a) transport; b) accommodation; c) tourist services not ancillary to transport or accommodation. The tourists have right to get a copy of the tour package sales contract. The contract constitutes the right to access the Guarantee Fund as per the following art. 19.

4 Reservations and conclusion of the contract: The acceptance of the reservation by Tours27 is also subject to the relative payment by the Consumer. The package purchase contract will be concluded when Tours27 will send the confirmation also by electronic system. The conditions relating to the tourist package not contained in the notes and details of the offer, or in other means of communication, will be provided, or indicated in the relative travel documents, by the organizer in regular fulfillment of the obligations provided for by art. . 37 paragraph 2 of the Tourism Code. in good time before the start of the trip.

This purchase contract is a distance contract, which has as its object tourist services and is stipulated between a professional Tours27 and a Consumer, as part of a remote service provision system organized by the professional who for such contract, uses only one or more remote communication techniques until the conclusion of the contract including the conclusion of the contract itself Pursuant to art. 32 paragraph 2 of the Tourism Code. Payments

5 Payments: At the time of booking, 25% of the price of the tourist package must be paid as a deposit. The balance must be paid at least 30 days before the scheduled departure, or in conjunction with the booking, if this is made within 30 days prior to departure. The non-payment of the aforementioned sums by the tourist constitutes an express termination clause such as to determine the resolution of law, with consequent application of the penalties provided for by art. 7, and this also in the event that the organizer has sent the tourist vouchers and transport tickets.

6 Price: The price of the tourist package is determined in the contract, with reference to what is indicated in the catalog or out-of-catalog program and any subsequent updates of the same catalogs and or out-of-catalog programs. It can be changed up to 20 days prior to departure and only as a result of changes in: <

– transport costs, including the cost of fuel;

– Rights and taxes on certain types of tourist services such as taxes, landing, disembarkation or embarkation fees in ports and airports;

– Exchange rates applied to the package in question.

The fluctuations will affect the flat-rate price of the tourist package in the percentage expressly indicated in the technical data sheet of the catalog or out-of-catalog program.

Modification and cancellation

7 Modification and Cancellation of the tour package before departure.

Before departure, the organizer or seller who needs to significantly modify one or more elements of the contract, immediately informs the consumer in writing, indicating the type of modification and the consequent price variation. If you do not accept the proposed modification referred to in paragraph 1, the consumer may alternatively exercise the right to reacquire the sum already paid or to enjoy the offer of a replacement tourist package pursuant to paragraph 2 and 3 of article 8 The consumer can exercise the above rights even when the cancellation depends on the failure to reach the minimum number of participants foreseen in the Catalog or in the out-of-catalog Program, or by cases of force majeure and unforeseeable circumstances relating to the tourist package purchased.

Withdrawn

8 Withdrawal by the consumer

The consumer can withdraw from the contract, without paying penalties, in the following cases:

– Price increase referred to in the previous art. 6 in excess of 10%;

In the cases mentioned above, the consumer has alternatively the right:

– To take advantage of an alternative tourist package, at no extra cost or with the refund of the excess price, if the second tourist package has a lower value than the first;

– To the refund of the only part of the price already paid. This return must be made within seven working days from the moment of receipt of the refund request.

The consumer must communicate his decision (to accept the modification or to withdraw) no later than two working days from the moment in which he received the notice of increase or modification. In the absence of communication within mentioned terms, the proposal of organizer is considered accepted. Consumer’s who withdraws from the contract before departure outside of the hypotheses listed in the first paragraph, will be charged – regardless of the payment of the deposit referred to in art. 5 / 1st paragraph – the individual cost of handling the file and the penalty to the extent indicated in the technical sheet of the Catalog or Program out of catalog or tailor-made travel. Changes in tour packages

9 Changes after departure: If after departure the organizer is unable to provide an essential part of the services covered by the contract for any reason, except for a fact of the consumer, he will have to arrange alternative solutions, without price supplements to be paid by the policyholder and if the services provided are of a lower value than those provided, reimburse him in an amount equal to this difference.

If no alternative solution is possible, or the solution prepared by the organizer is rejected by the consumer for serious and justified reasons, the organizer will provide, at no extra cost, a means of transport equivalent to the original one provided for the return to the place of departure. or to the different place eventually agreed, compatibly with the availability of the vehicle and places and will reimburse it to the extent of the difference between the cost of the services provided and that of the services performed up to the time of early return.

10 Substitutions: The renouncing customer can be substituted by another person provided that:

A The organizer is informed in writing at least 4 days before the date of departure, receiving at the same time communication about the identity of the transferee;

  1. the substitute satisfies all the conditions for the use of the service (pursuant to art. 89 of the Consumer Code) and in particular the requirements relating to passport, visas, health certificates;
  2. the successor subject to reimburse the organizer for all additional expenses incurred to proceed with the replacement to the extent that will be quantified before the transfer. Obligations

11 Obligations of the participants must have an individual passport or other document valid for all the countries covered by the itinerary, as well as residence and transit visas and health certificates that may be required. They must also comply with the rules of normal prudence and diligence and with the specific rules in force in the countries of destination of the trip, with all the information provided to them by the organizer, as well as with the regulations and administrative or legislative provisions relating to the tourist package.

Participants will be called to answer for all damages that the organizer should suffer due to their non-fulfillment of the obligations examined above. The consumer is required to provide the organizer with all documents, information and elements in his possession useful for exercising the right of subrogation of the latter towards third parties responsible for the damage and is liable to the organizer for the damage. The consumer must inform in writing to organizer, at the time of booking about the particular personal requests that may be the subject of specific agreements on the travel arrangements.

12 Liability regime

The organizer is liable for only for the services which are committed before the booking of the trip. All this services must be mentioned in the part of inclusion and exclusions. The seller with whom the tourist package was booked is not liable for accommodation quality (Hotel has Guidelines), services other than inclusions, personal expenses of the trip, or whatever which is not take part of the trip. The organizer is solely responsible for the obligations arising from his capacity as an intermediary and in any case within the limits for this liability provided for by the regulations in force. Assistance and complaints

13 Limits of compensation for personal injury cannot in any case exceed the limits provided for by the international conventions to which Italy and the European Union take part in relation to services whose non-fulfillment has led to their liability. In any case, the compensation limit cannot exceed the amount of 50,000 Germinal gold francs for personal injury, 2,000 Germinal gold francs for damage to property, 5,000 Germinal gold francs for any other damage (art. 13 n ° 2 CCV).

14 Obligation of assistance: The organizer is obliged to provide assistance to the consumer imposed by the criterion of professional diligence exclusively in reference to the obligations at his own expense by law or contract. The organizer and the seller are exonerated from their respective responsibilities (articles 13 and 14 of these General Conditions when the failure or incorrect execution of the contract is attributable to the consumer or has depended on the fact of an unforeseeable or unavoidable third party, or by a unforeseeable circumstances or force majeure.

15 Complaints and Complaints: Any failure in the execution of the contract must be contested by the consumer without delay so that the organizer, his local representative or the accompanying person can promptly remedy it. The consumer must – under penalty of forfeiture – also make a complaint by sending a registered letter, with acknowledgment of receipt, to the organizer or the seller, not more than 10 working days from the date of return from departure.

Insurance

16. Insurance against cancellation and repatriation costs If not expressly included in the price, it is possible, and indeed advisable, to take out special insurance policies at the time of booking at the offices of the organizer or seller against the costs deriving from the cancellation of the package, accident and baggage.
